Payment & Refunds Policy

This Payment & Refunds Policy outlines the payment terms, methods, and refund procedures for services provided by Smokely S.L through the homy.today platform.

1. Payment Terms

1.1 Subscription Billing

All subscriptions are billed annually in advance. Payment is due upon invoice receipt. Your subscription will activate once payment is confirmed.

1.2 Pricing

Subscription pricing is based on:

  • Hotels & Hotel Buildings: Per room pricing (from approximately €20-€45 per room depending on total rooms managed)
  • Holiday Homes: Per apartment pricing (from approximately €12-€17 per apartment)
  • Maintenance HORECA: Per apartment pricing (from approximately €3-€5 per apartment)

Prices are approximate and determined by the total number of units managed. Final pricing will be confirmed in your custom quote.

1.3 Currency

All prices are quoted and payable in Euros (EUR).

1.4 Taxes

Prices do not include applicable taxes, including VAT. Taxes will be added to your invoice as required by law.

2. Payment Methods

We accept the following payment methods:

2.1 Bank Transfer (SEPA)

Our preferred payment method for annual subscriptions. Please use the following bank details:

Important: Always include your invoice number in the payment reference to ensure proper credit to your account.

2.2 Credit Card

We accept major credit cards including Visa, Mastercard, and American Express. Credit card payments are processed through secure, PCI-compliant payment gateways.

2.3 Payment Processing Time

  • Bank Transfer: 1-3 business days for SEPA transfers
  • Credit Card: Instant processing

3. Late Payment

3.1 Payment Deadline

Payment is due within 14 days of invoice date unless otherwise agreed in writing.

3.2 Late Payment Consequences

If payment is not received by the due date:

  • A payment reminder will be sent after 7 days overdue
  • Access to the platform may be suspended after 14 days overdue
  • Account may be terminated after 30 days overdue
  • Late payment fees of 1.5% per month may be applied

4. Refund Policy

4.1 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee for new customers. If you are not satisfied with our services within the first 14 days of your subscription, you may request a full refund.

4.2 Eligibility for Refund

To be eligible for the 14-day money-back guarantee:

  • You must be a new customer (first-time subscriber)
  • Refund request must be made within 14 days of payment confirmation
  • You must not have violated our Terms of Use

4.3 Service Issues

If you experience significant service disruptions caused by our platform (not including third-party integrations or internet connectivity issues), you may be eligible for a prorated refund or service credit at our discretion.

4.4 Non-Refundable Situations

Refunds are not available in the following circumstances:

  • After the 14-day money-back guarantee period
  • Setup fees and implementation charges
  • Optional staff training services
  • Unused portion of the subscription period (after 14 days)
  • Cancellation by you for any reason after 14 days
  • Termination by us due to your breach of Terms of Use

6. Refund Processing

6.1 Review Period

Refund requests are reviewed within 3-5 business days. We may contact you for additional information.

6.2 Refund Timeline

Once approved, refunds are processed within:

  • Credit Card: 5-10 business days (depending on your bank)
  • Bank Transfer: 3-7 business days

6.3 Refund Method

Refunds are issued using the original payment method. If this is not possible, we will contact you to arrange an alternative method.

7. Price Changes

7.1 Notification

We reserve the right to change our pricing. You will be notified of any price changes at least 30 days before your renewal date.

7.2 Renewal Pricing

Price changes apply to renewals only. Your current subscription period will not be affected.

7.3 Right to Cancel

If you do not agree with a price change, you may cancel your subscription before the renewal date without penalty.

8. Subscription Cancellation

8.1 How to Cancel

You may cancel your subscription at any time by contacting our support team. Cancellation takes effect at the end of your current billing period.

8.2 No Prorated Refunds

Cancellation does not entitle you to a prorated refund for the unused portion of your subscription (except during the 14-day money-back guarantee period).

8.3 Data Retention

After cancellation, your data will be retained for 30 days, after which it will be permanently deleted unless you request otherwise or legal requirements mandate longer retention.

9. Chargebacks and Disputes

If you have any billing concerns, please contact us directly before initiating a chargeback with your bank. Chargebacks may result in immediate suspension of your account and additional fees.

10. Invoicing

10.1 Invoice Delivery

Invoices are sent via email to your registered account email address. You can also access invoices through your account dashboard.

10.2 Invoice Details

All invoices include:

  • Invoice number and date
  • Company details (Smokely S.L)
  • Your company details
  • Service description and pricing breakdown
  • Payment terms and due date
  • VAT registration number and applicable taxes

11. Additional Fees

11.1 Setup Fee

A one-time setup fee may apply depending on your subscription tier and implementation requirements. This fee covers:

  • Initial platform configuration
  • Data migration assistance
  • Third-party integration setup
  • On-site technical specialist visit

11.2 Optional Services

Additional fees apply for optional services:

  • Staff Training: Comprehensive team education (pricing upon request)
  • Custom Integrations: Specialized integration development
  • Priority Support: Dedicated account manager and faster response times
